Terms of Service

By creating an account or using SmarketHub in any way, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the platform. We may update these terms from time to time, and continued use of SmarketHub after changes take effect constitutes acceptance of the revised terms.

You must be at least 18 years old and able to form a legally binding contract to create an account on SmarketHub. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

• You must provide accurate, current and complete information when registering.
• You may not share your account or transfer it to another person.
• Notify us immediately if you suspect unauthorized use of your account.

Owners are responsible for the accuracy of their listings, including item condition, pricing, availability and any usage restrictions. Renters are responsible for using rented items as agreed and returning them on time and in the condition received, ordinary wear and tear excepted. Buyers are responsible for reviewing item details before completing a purchase.

All payments must be made through SmarketHub's platform. Prices shown at checkout include any applicable service fees, which will be clearly disclosed before you confirm a booking.

You agree to use SmarketHub in compliance with all applicable laws, to treat other users respectfully, and to honor the commitments you make when booking a rental or completing a purchase. You are solely responsible for any content you post, including photos and descriptions.

• Listing items you do not own or are not authorized to rent or sell.
• Circumventing SmarketHub to complete payments or communications off-platform.
• Posting false, misleading or fraudulent listings or reviews.
• Using the platform for any unlawful, harmful or abusive purpose.

You can cancel a purchase or rental free of charge before it is fulfilled — before the item is picked up by our courier partner, or before a rental period begins. Once fulfilled, returns, rental pickups, security deposit refunds and refund timelines are governed by our Return & Refund Policy, which also covers pre-fulfillment cancellations in more detail. In the event of a dispute between a renter or buyer and owner, our support team may step in to help reach a fair resolution.

SmarketHub acts as a marketplace connecting renters, buyers and owners and is not a party to the rental or sale agreement between them. To the fullest extent permitted by law, SmarketHub is not liable for indirect, incidental or consequential damages arising from your use of the platform or any rental or purchase transaction. In the event of a dispute between a renter or buyer and an owner, each party is responsible for their own legal, court and government fees or costs, and neither SmarketHub nor Samprino Tech Private Limited is liable to pay any lawyer, court or government fees arising from such a dispute.

You agree to indemnify and hold harmless SmarketHub, Samprino Tech Private Limited, and our officers, employees and affiliates from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the platform, your breach of these terms, or your violation of any law or the rights of a third party.

The SmarketHub name, logo, and platform design are the property of Samprino Tech Private Limited and may not be used without prior written permission. Content you upload remains yours, but by posting it you grant SmarketHub a license to display it on the platform.

If you believe content on SmarketHub infringes your intellectual property rights, send a written complaint to our Grievance Officer (see Section 13) describing the content, your rights, and supporting evidence. We will review valid complaints and take appropriate action, including removing infringing content, in accordance with applicable law.

We may suspend or terminate your access to SmarketHub if you violate these terms or engage in behavior that harms other users or the platform. You may also close your account at any time through your profile settings.

We are not liable for any delay or failure to perform our obligations under these terms where the delay or failure results from causes beyond our reasonable control, including natural disasters, strikes, internet or power outages, government action, or disruptions to our logistics or payment partners.

These Terms of Service are governed by the laws of India. Subject to the grievance redressal process described in Section 13, any dispute arising out of or in connection with these terms or your use of SmarketHub is subject to the exclusive jurisdiction of the courts at Pune, India.

In accordance with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023, the details of our Grievance Officer are as follows:

The Grievance Officer will acknowledge your complaint within 24 hours and endeavor to resolve it within 15 days of receipt, in accordance with applicable law.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and SmarketHub regarding your use of the platform.

We may revise these Terms of Service periodically. We'll post the updated version here with a new "last updated" date, and material changes will be communicated to you via email or an in-app notice.
